View Preservation - Tree/Bushes Obstructing View

Much of the appeal of Bay-O-Vista is the view that we enjoy.  Whether we enjoy the west view...San Francisco, the bay, the peninsula, Mt. Tam, etc., or the east view of the beautiful canyons and hilltops, it's always a better view when it's unobstructed.  Sometimes the view is blocked by unknowing neighbors who will clear the view when asked; other times the requests are ignored.  The Board of Directors has always taken a role in trying to help neighbors resolve issues regarding the loss of view due to the growth of trees or shrubs.  BOVIA does not have the authority to force people to abide by their CC&R's, but we can try to open a channel of communication between parties. 

Should a member of BOVIA request help from the BOVIA Board of Directors, our Director/Community Relations will send a letter to both partie.  The letter is informative in nature and is meant to advise both parties that further action can take place to resolve the issue. 

Additionally, the letter includes the result of past litigation that always has been decided in favor of those persons whose view had been obstructed.
